Terms of Service
Draft — not yet in effect. Operator details and an effective date will be added before ThinBlimp opens paid plans.
1. Who we are and what these Terms cover
ThinBlimp (the "Service") is operated by ThinBlimp, a limited liability company formed in the state named when these terms take effect ("we", "us"). These Terms govern your use of thinblimp.com, its apps, and anything we publish under the ThinBlimp name. By using the Service you agree to these Terms and to our Privacy Policy. If you do not agree, do not use the Service.
We may update these Terms. If a change is material we will tell you by email or on the Service before it takes effect. Continuing to use the Service after that means you accept the change.
2. What ThinBlimp is — and is not
ThinBlimp is an information and analytics service about prediction markets and sports betting lines.
- ThinBlimp does not accept wagers.
- We do not hold your money, execute trades, place bets, or transfer funds, and no part of the Service does any of those things on your behalf.
- We are not a broker, exchange, sportsbook, investment adviser, commodity trading advisor, or financial professional, and we are not registered as any of them.
- We are not affiliated with, endorsed by, or sponsored by any exchange, sportsbook, league, team, or data provider whose information appears on the Service. Their names and marks belong to their owners and are used only to identify the source of information.
3. Eligibility
You must be at least 18 years old and of legal age to trade event contracts or place sports wagers where you live, and not barred from doing so. Some features describe activity that is not lawful in every jurisdiction; it is your responsibility to know and follow the law where you are. We may limit or withhold features by location.
4. Your account
You are responsible for your login credentials and for activity under your account. Tell us promptly at the contact address published when these terms take effect if you think your account has been compromised. One person per account; do not share or resell access.
5. Plans, promotions and payment
The Service has a free tier and paid plans. What each plan includes is described on the pricing page and may change; we will not remove a paid feature you are currently paying for mid-term without notice and, where appropriate, a pro-rated refund. We may run time-limited promotions that open paid features to everyone; a promotion ends at the stated time without further notice.
Paid subscriptions are governed by our Subscription and Billing Terms (auto-renewal, cancellation, refunds), which form part of these Terms.
6. Information on the Service
6.1 Sources. Prices, odds, order books, scores, polls, news and other information on the Service come from prediction-market exchanges, sportsbooks, licensed data providers, and publicly available sources. We do not control those sources. Information may be delayed, incomplete, suspended, or wrong, and we may add, change or remove any source at any time.
6.2 Derived figures. Implied probabilities, "fair" values, edges, cross-venue gaps, arbitrage and hedge figures, fee-adjusted costs, order-book routing, and portfolio analytics are our own automated calculations applied to that information, without human review. See §10.
6.3 Attribution. Some information is used under licences that require credit, which we give where it appears and on our Data attribution page (for example, poll data from VoteHub under CC BY 4.0).
6.4 What you may do with it. You may view and use information on the Service for your own personal use. You may share images the Service produces for sharing (such as chart cards) with their ThinBlimp marks intact. You may not copy, scrape, export, resell, redistribute, or build a product or data feed from information on the Service — including odds and prices — except as these Terms expressly allow.
7. Connecting your exchange accounts
You may connect accounts you hold at prediction-market exchanges so the Service can show your positions, balances and history.
- You provide the credential — typically an API key the exchange issues to you, or a public wallet address. You must be the account holder or authorised by them.
- We only read. ThinBlimp uses a connected credential solely to read account information. We never use it to place, modify or cancel an order, or to move funds.
- Key permissions are set by you, at the exchange. Some exchanges let you create a key limited to reading; where that option exists, use it. Some exchanges' keys can trade and offer no read-only option; the Service tells you when that is the case, and you should connect such a key only from an account you are comfortable exposing to that risk. A key with trading permissions could be misused by anyone who obtained it, including in the event of a security breach affecting us.
- How we protect it. Secret keys are encrypted at rest and never returned to your browser after you submit them.
- You can disconnect at any time in Settings, and you can revoke the key at the exchange at any time, which ends our access immediately.
- The exchange's own terms continue to govern your account. We are not responsible for what an exchange does with your account.
8. Outbound links and third parties
The Service links to exchanges, sportsbooks, news publishers and other sites. We do not control them and are not responsible for them. Our Outbound links notice explains how those links work and whether we are ever paid for them.
9. No advice; no accuracy guarantee; your responsibility
Our Disclaimers page is part of these Terms. In summary:
- Nothing on ThinBlimp is financial, investment, tax, legal, or betting advice, or a recommendation to enter, hold, or exit any position or wager.
- The Service is provided "as is" and "as available." We do not warrant that any price, odds, probability, edge, fair value, arbitrage or hedge figure, fee calculation, order-book route, or position value is accurate, current, complete, or error-free. Prices can be stale; derived figures can be wrong even when their inputs are right; arbitrage and edge figures are theoretical and do not account for execution risk, slippage, partial fills, depth, suspensions, limits, account restrictions, or voided trades; fees and taxes are not fully modelled.
- You must confirm any price at the venue itself before acting on it. Trading event contracts and placing wagers involve substantial risk of loss. You are solely responsible for your decisions, for following each venue's rules, and for the legality of your activity where you are.
10. Acceptable use
You agree not to:
- scrape, crawl, or access the Service by automated means other than our published interfaces, or exceed or circumvent rate limits or plan limits;
- copy, resell, sublicense, or redistribute the Service or its information (see §6.4);
- reverse-engineer the Service or attempt to access data or features you are not entitled to;
- share your account, or use another person's account or credentials without authority;
- use the Service in connection with any activity that is unlawful where you are, including unlawful gambling;
- interfere with the Service, its security, or other users; or
- post content that is unlawful, infringing, deceptive, harassing, or that impersonates anyone.
11. Content you submit
If you post or react to content on the Service (for example, flagging a market as a "scoop"), you keep your rights in it and give us a worldwide, royalty-free licence to host, display and distribute it as part of the Service. You are responsible for it. We may remove any content at our discretion. If you connect a public profile (such as a display name, X handle or avatar), it may be shown next to your content.
12. Our intellectual property
The Service — its software, design, text, charts, calculations and the ThinBlimp name and marks — belongs to ThinBlimp or its licensors. These Terms give you a limited, personal, non-transferable right to use the Service and nothing more. Suggestions you send us may be used without obligation to you.
Copyright complaints: see our Copyright policy for how to report material you believe infringes your rights.
13. Responsible gambling
If betting or trading is causing you harm, help is available: call or text 1-800-GAMBLER. Our Responsible gambling page lists further resources and the tools exchanges and sportsbooks offer to set limits or self-exclude.
14. Limitation of liability
To the maximum extent permitted by law, ThinBlimp and its members, officers, employees and agents are not liable for any indirect, incidental, special, consequential, exemplary or punitive damages, or for lost profits, lost trading opportunities, trading or wagering losses, account restrictions or closures imposed by a third party, or lost data, arising out of or relating to the Service. Our total liability for all claims relating to the Service is limited to the greater of the amount you paid us in the twelve months before the claim arose, or US$100. Nothing in these Terms limits liability that cannot lawfully be limited.
15. Indemnity
You will defend and indemnify ThinBlimp against third-party claims arising from your breach of these Terms, your misuse of the Service, or your violation of any law or of any exchange's or sportsbook's terms — including claims arising from your decision to connect an account.
16. Suspension and termination
You may stop using the Service at any time, and ask us to delete your account by emailing the contact address published when these terms take effect. We may suspend or end your access if you breach these Terms, if required by law or by a data provider, exchange or sportsbook, or to protect the Service or other users. When an account is closed we disconnect every connected account and delete stored credentials. (Disconnecting an exchange in Settings already deletes its stored key.) Sections that by their nature should survive (including 9, 14, 15 and 17) survive.
17. Disputes and governing law
These Terms are governed by the laws of the state named when these terms take effect, without regard to its conflict-of-laws rules. Any dispute relating to the Service will be brought in the courts located there, and you consent to their jurisdiction, except that either of us may bring a qualifying claim in small-claims court.
18. General
These Terms, with the Privacy Policy and the Subscription and Billing Terms, are the whole agreement between you and us about the Service. If any part is unenforceable, the rest remains in effect. Our not enforcing a term is not a waiver. You may not assign these Terms; we may assign them in connection with a merger, acquisition or sale of assets.
